Class Actions for Collective Rights in Colombia (Acción Popular): When and How to Use It
## What is an "acción popular"?
The acción popular is enshrined in article 88 of the Colombian Constitution and regulated by Law 472 of 1998. It's the legal mechanism to protect collective rights and interests when they're threatened or violated.
Unlike a tutela (a constitutional protection action for individual rights), an acción popular protects interests that belong to the whole community.

When does it apply?
Whenever an action or omission (by public authorities or private parties) violates or threatens a collective right. The harm doesn't need to have already occurred — a real threat is enough.
Common examples: - Construction that encroaches on public space - A company polluting a water source - A local government failing to properly provide a public service - A public official acting corruptly
Who can file one?
Anyone can file an acción popular, without needing to be the directly affected party. A lawyer isn't strictly required (though it's advisable).
It can also be filed by: community organizations, NGOs, the Ombudsman's Office (Defensoría del Pueblo), and the Attorney General's Office (Procuraduría).
The process
- It's filed before the Administrative Tribunal (if the defendant is a public entity) or the Circuit Civil Court (if it's a private party)
- The judge admits the claim and notifies the defendants
- The judge may order urgent precautionary measures to prevent the harm
- There's a conciliation stage
- If there's no agreement, a hearing is held and the judge decides
Typical timeline: about 3 months on average (can run longer).
The financial incentive
Until 2011, a plaintiff who won an acción popular received a financial incentive of up to 150 times the minimum monthly wage. Law 1425 of 2010 eliminated that incentive.
Even so, the action remains a viable and effective way to protect collective rights.
