First, some context: Colombia's two pension systems
Colombia has two coexisting retirement systems:
- Colpensiones (RPM — Average Premium Regime): run by the State. The pension is calculated based on an average of salaries and weeks contributed. It especially favors people with mid-to-high salaries who will contribute for many years.
- Private funds (RAIS — Individual Savings Regime with Solidarity): run by AFPs (pension fund administrators) like Porvenir, Protección, Colfondos, or Old Mutual. The pension depends on the capital accumulated in your individual account plus the fund's returns. It can work well for certain profiles, but not all.
The law allows switching between these two regimes, but it imposes strict conditions — and that's where the problems arise.
When is a pension-regime transfer invalid?
Not every transfer is bad, but it can be void or voidable when:
1. You weren't properly informed before signing Colombia's Constitutional Court and Supreme Court of Justice have repeatedly established that pension advisors (especially those from private funds) have an obligation to provide clear, complete, and comparative information before the member makes the decision. If they only told you the fund's benefits and stayed quiet about the risks or what you'd lose by leaving Colpensiones, there's a defect in consent — meaning you signed without truly knowing what you were signing.
2. You were already close to retirement age at the time of the transfer The law states that you cannot switch regimes if you're 10 years or less from the minimum retirement age (57 for women, 62 for men). If an advisor transferred you while you were within that window, the transfer could be invalid as a matter of law. 3. There was pressure, deception, or false information If the advisor gave you inflated projections, promised you a pension the fund can't guarantee, or simply never gave you a written comparative advisory (mandatory under the Financial Superintendency's rules), there are grounds to challenge that transfer.
Practical steps to find out if your transfer was irregular
1. Locate the document you signed. Look for the private fund enrollment form or the transfer-from-Colpensiones form. Check the exact date and your age at that time.
2. Verify your work history. Ask the UGPP (Pension and Payroll Tax Management Unit) or your current fund for the report of contributed weeks and transfer history. This is free and can be requested online.
3. Compare what you would get under each regime. Colpensiones has a simulator on its website. Compare the pension projection under RPM against what your current fund projects for you. The difference can be hundreds of thousands of pesos a month — for life.
4. Check whether you had less than 10 years to retirement when you were transferred. Calculate your age at the time of the transfer. If you were already within the protected window, the transfer may have lacked legal validity from the start.
5. Consult a labor lawyer before making any move. This is the step most people skip — and the one that costs the most later. Many try to "fix it themselves" by requesting a transfer back to the fund, without knowing that doing so without a strategy can hurt a future legal claim.
Consequences of not acting

- Reduce the procedural options available, depending on when the transfer occurred and when the defect became known.
- Lock in the transfer as final, making it harder to reverse.
