Habeas Data in Colombia: How to Clear Your Name from DataCrédito or TransUnion
## The right to habeas data
Habeas data is the fundamental right to know, update, and correct information held about you in databases. It's enshrined in article 15 of the Constitution and governed by Law 1266 of 2008.
Credit bureaus (DataCrédito, TransUnion, Cifin) are private companies that collect and sell credit information. They're required to follow strict rules.
When can you be reported negatively?
For a credit provider (bank, credit union, financial institution) to report you negatively:
- You must have failed to meet an obligation
- The provider must notify you in advance, at least 20 days before making the report
- The debt must be real and enforceable
If you're reported without prior notice, the report is illegal and you should challenge it.
How long does the report last?
The double-time rule applies:
- If a debt was 1 month overdue, the negative report lasts a maximum of 2 months
- If the debt was 2 years overdue, the report lasts a maximum of 4 years
Absolute limit: No negative report can last more than 4 years from the date the obligation was paid, or more than 2 years after the obligation was extinguished for any other reason.
Many people don't know this: if you paid off a debt more than 4 years ago, the report should already have been removed.
How to check your status
- DataCrédito (Experian): midatacredito.com — allows 1 free check per month
- TransUnion: transunion.com.co
- Cifin (now TransUnion): miscore.com.co
Check for active reports, what they are, and their expiration date.
How to challenge an incorrect report
Step 1 — Request to the credit bureau: File a right-of-petition request with the bureau (DataCrédito, TransUnion) asking for correction or removal. They have 15 business days to respond.
Step 2 — If they don't respond or don't correct it: You can file a tutela (constitutional protection action) for violation of habeas data. Judges frequently grant these when: - The report has already expired - The debt was paid more than 4 years ago - There was no prior notice before the report was made
Step 3 — Complaint to the SIC: The Superintendency of Industry and Commerce oversees credit bureaus. It can impose fines and order corrections.
Reports of debts to the State
Debts to public entities (taxes, contributions) can also generate negative reports. The UGPP, DIAN, and health entities can report to the bureaus.
For these, the challenge process is similar, but the expiration period may differ.
Does immediate payment remove the report?
Not necessarily. Paying the debt doesn't automatically remove the negative report — the provider has up to 15 days to update it and reflect it as "current" or "extinguished obligation."
The record of the missed payment remains visible even once marked as paid, for as long as the report lasts.
