Do We Really Understand Artificial Intelligence and Its Legal Implications?

In academic and legal circles, interest in artificial intelligence (AI) has intensified, leading bodies such as the European Union and the Colombian Congress to develop rules that seek to regulate this powerful tool. Although these regulatory initiatives are well-intentioned, they are often enacted without a deep understanding of the technology and its true implications for the individuals protected by the law.

What is artificial intelligence? First, it is essential to understand that artificial intelligence is a tool programmed by humans that, depending on its design, can learn and evolve from the tasks assigned to it. This advance presents significant challenges, especially in the creation of images, videos, and text, where it is hard to distinguish between content manipulated by AI software and content generated by human creative processes.

Legal implications and information rights: In terms of information and the right to receive truthful data, it is crucial to have regulation that prevents AI from generating and spreading fake news that could deceive the public or improperly influence critical decisions, such as voting in national elections. We also face risks such as identity theft and the misuse of AI in unlawful activities, which is why the importance of regulating artificial intelligence in Colombia is emphasized.

Regulatory approach: Regulation should focus not only on artificial intelligence itself but also on those who develop these tools, ensuring they implement measures to protect people's rights. This approach ensures developers are responsible for preventing misuse of the technology.

The need for international regulation: Given the difficulty of applying regulations to tech giants, which hold dominant market power, it is imperative that regulatory efforts be led by international multilateral bodies. These bodies can represent the interests of global citizens and are crucial to minimizing the impact of technology corporations on society.

It is important to stress the need for a well-informed and internationally coordinated regulatory approach to address the challenges artificial intelligence presents in the legal and social sphere.
